These Terms and Conditions, along with privacy policy or other terms (“Terms”) constitute a binding agreement by and between ENKINDLER WELLNESS AND LIFE CARE LLP, ( “Website Owner” or “we” or “us” or “our”) and you (“you” or “your”) and relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, “Services”).

By using our website and availing the Services, you agree that you have read and accepted these Terms (including the Privacy Policy). We reserve the right to modify these Terms at any time and without assigning any reason. It is your responsibility to periodically review these Terms to stay informed of updates.

You agree and acknowledge that website and the Services may contain links to other third party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of such third party websites.
You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with the us for the Services.
You shall be entitled to claim a refund of the payment made by you in case we are not able to provide the Service. The timelines for such return and refund will be according to the specific Service you have availed or within the time period provided in our policies (as applicable). In case you do not raise a refund claim within the stipulated time, than this would make you ineligible for a refund.
Notwithstanding anything contained in these Terms, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.
These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.
All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Vakathanam, Kerala

The Enkindler Wellness & Life Care LLP may refuse to enter into an agreement or the agreement already in place may be cancelled with any of the customers in the following cases:

When the application violates the stipulations of these Terms and Conditions.
When the facilities are fully booked and the guest is not having any booking in his/her name.
When a potential guest is deemed likely to break the law, disrupt public order, or act contrary to public morals during their stay.
When a potential guest is deemed to fall under any of the following categories:
- An organized crime group under the Act on Prevention of Unjust Acts by Organized Crime Group Members hereinafter “organized crime group”, a member of an organized crime group as stipulated by the State or an associate member or affiliate of an organized crime group or any other antisocial force.
- When the guest is involved in corporations or other organizations whose operations are controlled by an organized crime group or a competitor.
- When any of the directors of the applicant’s corporation is classified as a member of an organized crime group.
- If the guest is intoxicated or behaving in an indecent manner to the employees or other guests or destructing any of the facilities of the firm or indulging any activities against the rules and regulations of the firm.
When the potential guest’s behaviour poses a significant nuisance to other guests.
When a potential guest is a patient of a specified infectious disease.
When the potential guest uses violence, threats, blackmail, or intimidation to make unjust or unreasonable demands against the firm or its employees.
When the potential guests repeatedly makes requests imposing an excessive burden and significantly hinders the provision of the firm’s services to the other guests.
When the firm is unable to accommodate guests due to natural disaster, facility malfunction, or other inevitable circumstances.
When the potential guest is intoxicated, exhibits or has exhibited extremely abnormal behaviour that may pose a nuisance to other guests, or in cases that fall under the provisions of laws of the land.
When the potential guest conceals the fact that they have come for the purpose of making a profit, either for themselves or for a third party, by selling goods, etc., and or any acts that infringe or risk infringing on the copyrights, trademarks, or other intellectual property rights, privacy rights, personal rights, or any other rights of other guests, third parties, the firm or any acts that violate or risk violating public order or law, or any criminal acts.
Loss or damage to any items, cash, or valuables shall not be the firm’s responsibility. The Guest shall keep all such items in safe custody.
The following activities are forbidden within the campus:
- Any acts which is against the laws of the land.
- Taking Photos/Video graphs of the treatments.
- Use of drugs or any other materials.
- Copying any information from the firms computer related to its business or its customers or clients.
- Taking or misplacing any Artworks and antiques.
- Keeping any dangerous goods, explosives etc.
The firm shall be entitled to claim compensation from the guest for any damages incurred as a result of the acts as mentioned in the above paragraphs.
When the potential guest does not comply with these Terms and Conditions, the firm shall automatically apply the cancellation policy without any further notice.
In such situations the firm shall have the right to cancel the guest booking and shall apply payment policies used while booking.
